Terms of Use

This document defines the terms of participation in the DP Smart Community and use of the @DPSmartBot bot in the Telegram messenger. Please carefully review these Terms before registration.

1. General Provisions

1.1. This user agreement (hereinafter referred to as the "Terms") establishes the rules for using the @DPSmartBot bot (hereinafter referred to as the "Bot") and participating in the DP Smart Community (hereinafter referred to as the "Community").

1.2. By completing registration in the Bot, the User is deemed to have accepted these Terms in full, without reservations or exceptions. If the User disagrees with the Terms, the User must cease registration and not use the Bot.

1.3. These Terms may be amended with notification to the User via a personal message in the Bot. The new version of the Terms comes into effect from the moment of its publication in the Community knowledge base at kb.dpsmart.gifts.

1.4. In the event of amendments to the Terms with which the User disagrees, the User must cease participation in the Community. Any actions performed by the User in the Bot after the new version of the Terms comes into effect constitute confirmation of agreement with the updated Terms.

1.5. Participation in the Community is available only to adults (18 years and older). By registering in the Bot, the User confirms having reached the age of majority in accordance with the laws of their jurisdiction.


2. Key Definitions

TON The Open Network blockchain, where all Community transactions are executed
Smart Contract A program on the TON blockchain that automatically executes gift distribution rules without manual intervention
Gift Tracking Board A digital tracking system of 15 positions that records the order of sending and receiving gifts
Member An individual registered in the Bot who has accepted these Terms
Mentor A member through whose invitation link a new User registered
Wallet A Tonkeeper cryptocurrency wallet linked to the smart contract for automatic receipt of gifts

3. Subject of Agreement

By completing registration in the Bot, the User accepts and confirms the following:

3.1. DP Smart is an international Community of mutual gifts that uses the @DPSmartBot Bot to provide technical support for interaction between members.

3.2. The Bot is a decentralized tool that connects members using an algorithm for the purpose of gratuitous transfer of gifts in USDT to each other.

3.3. All gifts within the Community are transferred by members voluntarily and gratuitously. A gift is non-refundable — after sending it to the Recipient, it is impossible to return it.

3.4. Gifts are sent directly — from the Giver's wallet to the Recipient's wallet — through a smart contract. Without intermediaries and without a single account. The smart contract automatically withholds a fixed technical fee to maintain infrastructure (details in section 12).

3.5. The decision to participate in the Community, give and receive gifts is completely voluntary and conscious.

3.6. The Community does not provide any guarantees of receiving gifts. The result depends on the member's personal activity and the activity of other members on the Board.

3.7. DP Smart does not constitute investment, financial, or commercial activity. The Community does not meet the criteria of a financial pyramid, multiplication scheme, or any prohibited financial schemes.

3.8. Tax issues related to receiving gifts are resolved by each member independently in accordance with the laws of their jurisdiction.

3.9. Within the Community, Rules of interaction on gift tracking Boards (hereinafter referred to as the "Rules") apply, which must be followed. The Rules are published in the Community knowledge base.

3.10. Before each entry onto a Board, the smart contract conducts an automatic fund cleanliness check (AML). The User must use USDT from verified sources.


4. What is Absent in the DP Smart Community

Transparency of Principles

The following points reflect the fundamental principles of the Community's operation. Each member must understand them before beginning interaction.

4.1. There is no single wallet or master account. No one collects members' funds to a single address. All gifts are transferred directly between members' wallets.

4.2. There is no third-party control. Gifts move from member to member automatically through a smart contract without intermediaries.

4.3. There is no investment, commercial, or any business activity. The Community does not accept funds for management, does not conduct trading or financial activities.

4.4. There is no promised return. There are no interest rates, percentages, or guaranteed income from participation.

4.5. There are no regulated timeframes. The speed of receiving gifts and Board splits is not regulated and depends on member activity.

4.6. There are no accumulations. Members' funds are not accumulated or stored in the Bot or on Community servers. All USDT are in members' personal wallets or in the process of transfer through the smart contract.

4.7. There is no link between gifts and invitations. Receiving gifts does not directly depend on inviting new members. Invitations affect qualification and Board filling speed, but are not a source of income.

4.8. There is no multi-level hierarchy. All members are on equal terms. There are no privileges for early registration, no leadership positions, no pyramidal development.

4.9. There are no referral rewards. Members do not receive monetary bonuses, percentages, or rewards for inviting new people to the Community.

4.10. There is no collection of personal data. The Bot does not collect or store members' personal data, except for Telegram ID, username, and linked wallet address.


5. Rights and Obligations of Members

A member has the right to:

5.1. Voluntarily send and receive gifts in accordance with the Community Rules.

5.2. Invite new members to the Community via a personal invitation link.

5.3. Activate gift tracking Boards sequentially — from Starter to Titanium — in accordance with level access rules.

5.4. Contact technical support regarding issues related to the Bot and smart contract operation.

5.5. Within 15 minutes after entering a Board, decide whether to send a gift or leave the Board (considering the consequences described in section 8).

5.6. Manage the partner distribution mode on their Boards (Auto / Left / Right) when in the Recipient position.

A member is obligated to:

5.7. Comply with these Terms and Community Rules.

5.8. Maintain Global activity (inviting a new member at least once every 48 days) and Current activity (interacting with the Bot at least once every 48 hours).

5.9. Use USDT from verified sources that have passed AML verification (Telegram Wallet, Binance, Bybit, TON exchangers, and other verified services).

5.10. Bear personal responsibility for the security of their Telegram account and cryptocurrency wallet.

5.11. Independently resolve tax issues related to receiving gifts in accordance with the laws of their jurisdiction.

5.12. Not create multiple accounts (multi-accounts). Each member uses one primary account.


6. Member Interaction Obligations

Community members are prohibited from:

6.1. Promising or guaranteeing any return, interest, timeframes for receiving gifts, or financial results from participating in the Community.

6.2. Associating the Community's activities with investments, business, network marketing, or any commercial activity.

6.3. Forecasting the speed of Board splits and the speed of receiving gifts.

6.4. Sending as a gift funds obtained as loans from credit institutions, as well as the last funds from the family budget.

6.5. Engaging in rude, offensive, or toxic communication with other members — both in private messages and in Community group chats.

6.6. Organizing third-party schemes (live queues, pools, attempts to bypass the algorithm).

6.7. Conducting aggressive recruitment into other projects within the Community.

6.8. Performing actions deliberately harmful to the Community or its members.

Mandatory Terminology

Members are required to use correct terminology when communicating within the Community and when representing it.

7. Confirmations When Entering a Board

Before each entry onto a gift tracking Board, the Bot requests a series of confirmations from the member. Each response is recorded and confirms conscious acceptance of the terms.

The member confirms:

1 Contact with mentor and availability of a free Giver position on the required Board
2 Awareness of temporary blocking when leaving the Board (from 72 to 288 hours)
3 Readiness to send a gift to the member in the Recipient position
4 Understanding the non-refundability of the gift — after sending it to the Recipient, it is impossible to return the gift
5 Waiver of guarantees — sending a gift does not guarantee receiving gifts from other members
6 Consent to reserving the gift amount in the smart contract and automatic sending after 15 minutes
7 Being of legal age, voluntary actions, legal capacity, and awareness of consequences
8 Readiness to top up the smart contract with the USDT amount to send the gift

8. Temporary Blocking

The algorithm automatically applies temporary restrictions in the following cases:

Basis Description
Leaving the Board The member left the Board within the 15-minute technical window after entry (before sending the gift)
Recipient Replacement The member was assigned as Recipient but did not confirm activity. The algorithm temporarily replaced them with a system account

Blocking periods (depend on the number of violations since registration):

1 First time — 72 hours (3 days)
2 Second time — 144 hours (6 days)
3 Third and subsequent — 288 hours (12 days)

During temporary blocking: entry to Boards is unavailable, the Recipient role is unavailable, gifts are not credited, the member does not participate in compression. Blocking on one Board affects all the member's positions on other Boards.

Early Unblocking

A member can prematurely end the temporary blocking period. Cost — 150 USDT. Funds are directed to maintaining Community infrastructure. The violation counter is not reset.

9. Permanent Blocking

To protect the Community, permanent account blocking is provided. It is applied in the following cases:

9.1. Insults, threats, or toxic behavior in Community public chats.

9.2. Organizing third-party schemes — live queues, pools, attempts to bypass the algorithm.

9.3. Aggressive recruitment into other projects within the Community.

9.4. Deliberate actions harmful to the Community or its members.

9.5. Gross or systematic violation of these Terms or Community Rules.

Consequences of permanent blocking:

The member's wallet is added to the smart contract blacklist. Any interaction with the Bot is completely terminated. Participation on Boards and receiving gifts becomes impossible. Permanent blocking has no expiration date and is not subject to removal or review.

The decision on permanent blocking is made by the Community team or based on voting results of mentors and partners based on documented evidence (screenshots, recordings, videos).


10. Service Fees

Account Recovery / Wallet Change 150 USDT Re-linking the account to a new Telegram ID or wallet. All data, positions, and history are preserved
Important

Paid service actions do not affect the gift distribution algorithm and do not provide advantages over other members. Funds are directed to maintaining Community infrastructure.

11. Member Activity

For correct algorithm operation and protection of active members, the Bot has two types of activity:

Global Activity

Period: 48 days

Updated when inviting a new member who sent a gift on the Starter Board.

Grants the right to become a Recipient on the Board.
Current Activity

Period: 48 hours

Updated with any interaction with the Bot (pressing buttons in the main menu).

Works only when Global activity is present.

In the absence of either type of activity, the member receives the status "Sleeping". Consequences: exclusion from compression, blocking advancement to the Recipient position, temporary replacement with a system account, and suspension of notifications.


12. Smart Contract and Fees

12.1. The smart contract automatically manages the gift distribution process. Manual intervention is absent. All operations are recorded in the public TON blockchain registry.

12.2. Smart contract fee — a built-in mechanism that covers: TON blockchain transaction fees, smart contract operation, infrastructure (servers, Bot, monitoring, security).

12.3. The fee is automatically withheld only from the Recipient at the moment of receiving the gift. The Giver always sends an exact amount.

12.4. On first entry to a Board, the standard TON network fee is used. Subsequently, all processes are paid from the smart contract fee.

12.5. Before entering a Board, the member's wallet must have a small reserve of TON to pay the network fee.


13. Gift Distribution

Upon becoming a Recipient, a member can receive up to 8 gifts. They are distributed automatically:

Gift Purpose
№ 1 Goes to the member's personal wallet
№ 2 and № 3 Automatically reserved for activating the next Board (if not yet activated). If activated — go to the wallet
№ 4, 5, 6, 7 Go to the member's personal wallet
№ 8 Automatically reserved for re-entry to the Board of the same level

All operations are performed automatically by the smart contract. Manual intervention is absent.


14. Key Timers

All timers start and execute automatically. The DP Smart technical team does not accelerate, slow down, or manually change them.


15. Community Technical Team

15.1. The DP Smart technical team ensures stable operation of the Bot and smart contracts, and provides technical support to members.

15.2. The technical team is not a party to interactions between members, does not bear responsibility for the actions of other people, does not provide guarantees or timeframes for receiving gifts.

15.3. The technical team cannot guarantee uninterrupted Bot operation due to server loads, blockchain updates, or other circumstances that may affect performance.

15.4. The technical team has the right to unilaterally block members who grossly violate these Terms or harm the Community. Blocking occurs after detailed review of the situation based on documented evidence.

15.5. The technical team does not bear responsibility for members' funds and cannot guarantee compliance by other members with the Community Rules and Terms.

15.6. Technical support never requests confirmation codes, wallet secret phrases, or access to members' personal accounts.


16. Privacy and Data

16.1. The Bot processes a minimal set of data: Telegram ID, username, and linked wallet address.

16.2. Members accept that their Telegram username is visible to other members on gift tracking Boards.

16.3. When entering a Board, an automatic AML check of fund cleanliness is conducted. The check does not involve transfer of the member's personal data. Only the source of USDT receipt to the wallet is verified.

16.4. All transactions are recorded in the public TON blockchain registry. Blockchain data is publicly accessible by nature.


17. Limitation of Liability

17.1. DP Smart is a decentralized Community. Members make decisions independently and interact directly.

17.2. The technical team does not bear responsibility for: members' financial losses; actions or inaction of other members; cryptocurrency value fluctuations; TON blockchain failures; loss of access to Telegram account or wallet due to the member's fault.

17.3. The result of participation depends on Community activity and each person's personal participation. No guarantees of receiving gifts are provided.

17.4. The member accepts all risks associated with using cryptocurrencies, including but not limited to: technical failures, errors in wallet addresses, changes in cryptocurrency regulation in the member's jurisdiction.

17.5. If you do not agree with the rules or philosophy of active participation, the best decision would be not to participate in the Community.


18. Acceptance of Terms

Mandatory Reading

By clicking the confirmation button during registration in the Bot, the member unconditionally and fully accepts everything stated in these Terms. Information about this is stored in the Community system.

18.1. These Terms are not a public offer.

18.2. These Terms come into effect from the moment of the member's registration in the Bot and remain in effect throughout the entire period of participation in the Community.

18.3. All DP Smart rules were created together with Community members, formed and refined since 2022. They were implemented with one goal — so that active members move forward, and the Community's movement is not slowed down by inactive accounts.
